Landlords & Tenants – What are the Obligations?

Both the landlord and the tenant have legal rights and obligations and the law is there to protect both parties.

All landlords must make sure they are fully aware of all their obligations, including The Disability Discrimination Act, Sex Discrimination Act and Race Relations Act which also apply to anyone letting, selling or managing property. If you are in doubt about anything seek legal advice.

What is the landlord responsible for?

  • ensuring that the property is fit for habitation
  • repairing the structure and exterior of the property,
  • maintaining and cleaning the common areas in multi-occupancy dwellings
  • ensuring heating and hot water installations are safely maintained
  • ensuring that all basins, sinks, baths and other sanitary installations are safe and free from health hazards
  • ensuring all gas and electrical equipment is safely installed and maintained
  • ensuring the fire safety of furniture and furnishings you provide in the property
  • following fire safety regulations
  • providing an Energy Performance Certificate for the property
  • protecting your tenant’s deposit in a government-approved scheme

What is the tenant responsible for?

  • paying the agreed rent
  • taking good care of the property
  • repairing or paying for any damages they have caused
  • paying bills for gas, electricity, telephone, ( if part of the tenancy agreement)
  • paying the council tax, water and sewerage charges ( if part of the tenancy agreement)
  • allowing your landlord access to the property to inspect it or carry out repairs.

He should give you at least 24 hours’ notice unless it’s an emergency.
